Sale at public auction will be on December 28, 2017 at 3:00PM local time, at the east door, Lawrence County Courthouse, 240 West Gains Street, Lawrenceburg, Tennessee pursuant to Deed of Trust executed by Garrie Childress and Wallace Childress, to Alan C. Betz, Trustee, as trustee for Mortgage Electronic Registration Systems, Inc. as nominee for GMFS, LLC on September 9, 2005 at Book 204, Page 423, Instrument No. 05005820; conducted by Shapiro & Ingle, LLP, having been appointed Substitute or Successor Trustee, all of record in the Lawrence County Register's Office. Default has occurred in the performance of the covenants, terms, and conditions of said Deed of Trust and the entire indebtedness has been declared due and payable.

Being and lying in the Tenth (10th) Civil District of Lawrence County, Tennessee, lying west of and adjacent to Buffalo Road, being more particularly described as follows: Beginning at an iron pin set in the west ROW of Buffalo Road, said point being the northeast corner of Shirley Hill as recorded in Record Book 63, page 536, ROLCT, and being the southeast corner of the tract being described; thence leaving said west ROW with Hill North 72 degrees 21 minutes 09 seconds West 115.85 feet to an iron pin found, said iron pin being the northwest corner of Hill, and being the northernmost northeast corner of Willie Byrd as recorded in Deed Book 121, page 29, ROLCT; thence leaving Hill with Byrd North 72 degrees, 07 minutes 14 seconds West 416.82 feet to an iron pin found, said iron pin being the northwest corner of Byrd, and being in the east boundary of Michael Blackwood as recorded in Deed Book 300, page 592, ROLCT, and being the southwest corner of the tract being described; thence leaving Byrd with Blackwood North 7 degrees 42 minutes 10 seconds East 78.79 feet to an iron pin found, North 5 degrees 59 minutes 57 seconds East 33.63 feet to an iron pin set, said iron pin being the southwest corner of Hughie Lemay as recorded in Deed Book 200, page 192, ROLCT, and being the northwest corner of the tract being described; thence leaving Blackwood South 71 degrees 55 minutes 40 seconds East, and passing the northwest corner of Morris Thompson as recorded in Deed Book 290, page 30, ROLCT, in all 600.55 feet to an iron pin set in the west ROW of Buffalo Road, said iron pin being the northeast corner of the tract being described; thence leaving Thompson with said west ROW South 41 degrees 24 minutes 59 seconds West 117.76 feet to the point of beginning and containing 1.42 acres, as surveyed by Kenneth Carroll, RLS. TN License #1335, September 30, 2002 as revised on October 11, 2002.
THERE IS AN AGREED BOUNDARY LINE INCLUDED IN THE ABOVE DESCRIBED TRACT, BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
Beginning at an iron pin set, said iron pin being the southwest corner of Hughie Lemay as recorded in Deed Book 220, page 192, ROLCT, and being in the east boundary of Michael Blackwood as recorded in Deed Book 300, page 592, ROLCT; thence leaving Blackwood with Lemay South 71 degrees 55 minutes 40 seconds East, and passing the southeast corner of Lemay and the southwest corner of Morris Thompson as recorded in Deed Book 290, page 80 ROLCT, in all 600.55 feet to an iron pin set in the east ROW of Buffalo Road, said iron pin being the end of said agreed boundary line.
This being the same property conveyed to Timothy W. Shelton and wife, Leann B. Shelton from Federal National Mortgage Association by Special Warranty Deed dated September 27, 2002 of record in Record Book 93, Page 199, ROLCo., Tennessee. For further source of title see Establishment of Boundary Line of record in Record Book 93, Page 201, ROLCo., Tennessee.
This also being the same property conveyed to Wallace Childress and wife, Garrie Childress from Timothy W. Shelton and wife, LeAnn B. Shelton by deed dated Sept. 9, 2005 of record in Record Book 204, Page 421, ROLCo., Tennessee.

The street address of the above described property is believed to be 3289 Buffalo Rd, Ethridge, Tennessee 38456, but such address is not part of the legal description of the property sold herein and in the event of any discrepancy, the legal description herein shall control.
This sale is subject to, without limitation, all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory right of redemption of any governmental agency, state or federal; any prior liens or encumbrances including those created by a fixture filing or any applicable homeowners' association dues or assessments; all claims or other matters, whether of record or not, which may encumber the purchaser's title and any matter that an accurate survey of the premises might disclose.
The following parties may claim an interest in the above-referenced property to be affected by the foreclosure: any judgment creditor or lien holder with an interest subordinate to the said Deed of Trust or any party claiming by, through, or under any of the foregoing. Such parties known to the Substitute Trustee may include: GMFS, LLC.
Terms of Sale will be public auction, for cash, free and clear of rights of homestead, redemption and dower to the extent disclaimed or inapplicable, and the rights of Garrie Childress and Wallace Childress, and those claiming through him/her/it/them.
Any right of equity of redemption, statutory and otherwise, and homestead are waived in accord with the terms of said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee.
The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above. If you purchase a property at the foreclosure sale, the entire purchase price is due and payable at the conclusion of the auction in the form of a certified/bank check made payable to or endorsed to Shapiro & Ingle, LLP. No personal checks will be accepted. To this end, you must bring sufficient funds to outbid the lender and any other bidders. Insufficient funds will not be accepted. Amounts received in excess of the winning bid will be refunded to the successful purchaser at the time the foreclosure deed is delivered.
This property is being sold with the express reservation that the sale is subject to confirmation by the lender or trustee. This sale may be rescinded only by the Substitute Trustee at any time. If the Substitute Trustee rescinds the sale, the purchaser shall only be entitled to a return of any money paid towards the purchase price and shall have no other recourse. Once the purchaser tenders the purchase price, the Substitute Trustee may deem the sale final in which case the purchaser shall have no remedy. The real property will be sold AS IS, WHERE IS, with no warranties or representations of any kind, express or implied, including without limitation, warranties regarding condition of the property or marketability of title.
