WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated September 27, 2000, and the Deed of Trust of even date securing the same, recorded September 28, 2000, in Book No. 28, at Page 99, in Office of the Register of Deeds for Lawrence County, Tennessee, executed by Tommy Kenneth Tucker and Kelli L. Tucker, conveying certain property therein described to Paul B. Plant as Trustee for Johnny Thompson and wife, Linda Thompson; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee by M & T Bank.
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee, by M & T Bank, will, on March 6, 2017 on or about 11:00 AM, at the Lawrence County Courthouse, Lawrenceburg, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Lawrence County, Tennessee, and being more particularly described as follows:
A certain tract of land lying in the Eleventh Civil District of Lawrence County, Tennessee on the North side of a new gravel road and South of State Route 20 and being a portion of BPH Development, LLC, as shown of record in the Register's Office of Lawrence County, in Deed Book 292, Page 754,; being more fully described as follows: Beginning at an iron pipe at the Southwest corner of the lands of Lonnie Mayce as shown in Deed Book 258, Page 542,; thence running with lines of division South 3 degrees 27 minutes 04 seconds West 161.81 feet to a steel pin; thence South 3 degrees 27 minutes 04 seconds West 50.00 feet to a point in the center of a new gravel road; thence running in said road North 89 degrees 56 minutes 53 seconds West 280.30 feet; thence South 79 degrees 18 minutes 00 seconds West 180.46 feet; thence leaving said road North 0 degrees 51 minutes 55 seconds West 30.00 feet to a steel pin; thence North 0 degrees 51 minutes 55 seconds West 513.67 feet to a steel pin; thence South 76 degrees 05 minutes 43 seconds East 520.45 feet to an iron pipe; thence running with Mayce's West boundary South 8 degrees 42 minutes 39 seconds West 175.79 feet to the Point of Beginning Containing 5.0007 acres of land more or less. Description according to D.P, Surveying Tennessee Registered Land Surveyor 1693, dated September 21, 1997. Subject to a seventy foot road and utilities easement center of the South boundary of the above described tract.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. In addition, the following parties may claim an interest in the above-referenced property:
The sale held pursuant to this Notice may be rescinded at the Successor Trustee's option at any time. The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above.
