WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated June 22, 2012, and the Deed of Trust of even date securing the same, recorded June 22, 2012, in Book No. DT500, at Page 119, in Office of the Register of Deeds for Lawrence County, Tennessee, executed by Laura Rogers and Jason E. Rogers, conveying certain property therein described to David P. Dempsey as Trustee for Fifth Third Mortgage Company; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee by Fifth Third Mortgage Company.
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee, by Fifth Third Mortgage Company, will, on March 23, 2015 on or about 11:00 AM, at the Lawrence County Courthouse, Lawrenceburg, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Lawrence County, Tennessee, and being more particularly described as follows:
A certain tract of land lying in the 14th Civil District of Giles County, Tennessee on the N.E. side of Anderson Creek Road about 2 miles East of the Old Military Road; being a portion of the property described in Deed Book 168, Page 107, Register's Office of Giles County, Tennessee; and being more particularly described as follows:
Beginning at a point in the center of Anderson Creek Road, David Chapman's S.W. corner; thence with the center of Anderson Creek Road, N 30° 15' 10" W, 257.36 feet; N 26° 14' 22" W, 227.71 feet; and N 31 ° 11' 35" W, 48.49 feet to a point in the center of the road; thence with Frank Buchanan, N 25° 15' 29" E, 852.59 feet to an iron pin; thence with Buchanan and Edward Welch, S 81° 10' 00" E, 433.49 feet to an iron pin; thence with David Chapman and a wire fence as follows:
S 6° 55' 53" W, 249.12 feet; S 0° 34' 41" E, 397.37 feet; S 8° 13' 54" W, 274.08 feet; S 49° 16' 20" W, 315.90 feet; S 44° 04' 14" W, 78.46 feet; and N 82° 56' 18" W, 179.60 feet to the Point of Beginning and containing 15.91 acres, more or less.
Also an easement for water rights to a spring situated in a hollow about 600 feet North of the N.B.L. of the above described tract. Said easement is 50 feet in width lying 25 feet either side of the centerline, the centerline being described as follows:
Beginning at a point in the NBL of the above described tract 37 feet West of a 20" Red Oak; David Chapman's corner; thence running N 34° 05' W, 347 feet, and N 29° 50' W, 242 feet (at all points 25 feet S.W. of and parallel to David Chapman's W.B.L.) to a point 25 feet North of the spring.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. In addition, the following parties may claim an interest in the above-referenced property:
The sale held pursuant to this Notice may be rescinded at the Successor Trustee's option at any time. The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above.
