OF REAL ESTATE
WHEREAS, on July 20, 2007, by Deed of Trust in the Register's Office of Lawrence County, Tennessee, in Book 267, Page 526, DOUGLAS MURAWSKI, unmarried, and ANASTACIA MARCO, unmarried, conveyed to T. Mike Estes, Trustee, the hereinafter described real estate to secure the payment of promissory note of even date therewith payable to the order of Farm Credit Services of Mid-America, FLCA, in the original principal amount of Three Hundred Thirty-Nine Thousand Five Hundred Fifty and 00/100 Dollars ($339,550.00); and
WHEREAS, the undersigned was appointed Substitute Trustee by Appointment of Substitute Trustee dated May 22, 2015, of record in Book 455, Page 408, in the Register's Office of Lawrence County, Tennessee;
WHEREAS, default has been made in the payment of said indebtedness and other provisions of the Deed of Trust have been violated, and FARM CREDIT MID-AMERICA, FLCA, the holder of the said indebtedness, has declared the entire amount of the note due and payable as provided in said Deed of Trust and the Substitute Trustee has been directed to foreclose the Deed of Trust in accordance with the terms thereof, the public is hereby notified that the Substitute Trustee or its designated agent will sell the hereinafter described real estate at Public Auction, to the highest and best bidder, for cash in hand, at the Lawrence County Courthouse in Lawrenceburg, Tennessee, on July 15, 2015, at the hour of 10:00 A.M., Uniform Standard Time; said property to be sold in bar of the right of redemption and subject to the lien of all special assessments against the property. The street address of the property is 2495 Rocky Lane, Lawrenceburg, TN, and is more particularly described as follows:
TRACT 1: Situated, lying and being in the Sixth (6th) Civil District of Lawrence County, Tennessee on the waters of Spring Creek, and more particularly described as follows:
BEGINNING on a forked white oak, the northwest corner of a survey made by Thos. H. Lawhorn for 53 acres; thence East with his line 75 poles to a hickory, his corner; thence South 18 poles to a hickory, his corner; thence East 42 poles, a chestnut, his corner; thence North 24 poles, a maple stump on west bank of said creek; thence East 52 poles to a stake, said Lawhorn's corner; thence South 9 poles, a stake; thence East 10 poles, a hickory; thence North 66 poles, a stake; thence West 44 poles, a dogwood; thence North 30 poles, a white oak; thence West 145 poles, a stake; thence South 93 poles to the beginning and containing 100 acres, more or less and known as the Samuel Williams tract and was conveyed to said Williams by John A. Hagan.
TRACT 2: Situated, lying and being in the Sixth (6th) Civil District of Lawrence County, Tennessee, on the waters of Little Spring Creek, about 2-1/2 miles West of West Point Road and lying North of Waterloo Road, adjacent to and majorally West off Rocky Lane and described as follows:
BEGINNING at an iron pipe at the mouth of a spring branch, just west of Rocky Lane and 112 feet north of the center of Waterloo Road and in Little Spring Creek; thence with the center of Little Spring Creek, North 50 degrees 45 minutes West, 89 feet; North 86 degrees 30 minutes West 100 feet; North 76 degrees 30 minutes West 268 feet; North 19 degrees 30 minutes West 27 feet; North 78 degrees 15 minutes West 76 feet and South 85 degrees 10 minutes West 93 feet to a stake at the fence, W.E. Bowden's east boundary line; thence with Bowden's east boundary line, North 10 degrees West 70.7 feet to a white oak and fence corner; thence with the fence and Bowden's north boundary line North 80 degrees West 680 feet to a hackberry; thence with Bowden's east boundary line and a fence North 4 degrees East 468 feet to a large elm and fence corner of W. A. Included in the above description, but specifically excluded therefrom is the 1.20 acres conveyed to Ronda Denece Gray in Book 289, Page 124, Register's Office of Lawrence County, Tennessee, to which reference is hereby made for a more complete description.

TRACT 3: Being and lying in the Sixth (6th) Civil District of Lawrence County, Tennessee, south of and adjacent to Rocky Lane, being more particularly described as follows:
BEGINNING at an iron pin set in the south right-of-way of Rocky Lane, said iron pin being the northern most northwest corner of the tract being described; thence with said south right-of-way North 75 degrees 50 minutes 51 seconds East 98.69 feet to an iron pin set, said iron pin being in the remaining property of William Clark et ux as recorded in Deed Book 219, Page 672, ROLCT, and being the northeast corner of the tract being described; thence leaving said south right-of-way with a new Clark division line South 35 degrees 58 minutes 05 seconds West 167.58 feet to an iron pin set; South 45 degrees 01 minute 46 seconds West 367.18 feet to an iron pin set; South 61 degrees 20 minutes 45 seconds West 171.85 feet to an iron pin set; South 1 degree 06 minutes 58 seconds West 14.20 feet to an iron pin set, said iron pin being the southeast corner of the tract being described; thence continuing with said division line North 89 degrees 19 minutes 57 seconds West 202.81 feet to an iron pin set, said iron pin being in the east boundary line of W.A. Clark, North 6 degrees 11 minutes 19 seconds East 127.59 feet to an iron pin set, said iron pin being in the remaining property of William Clark, and being the western most northwest corner of the tract being described; thence leaving WA Clark with a new William Clark division line South 73 degrees 13 minutes 50 seconds East 198.87 feet to an iron pin set; North 61 degrees 20 minutes 49 seconds East 143.29 feet to an iron pin set; North 46 degrees 01 minutes 45 seconds East 366.99 feet to an iron pin set North 21 degrees 37 minutes 14 seconds East 72.82 feet to the point of beginning, and containing 1.20 acres as surveyed by Kenneth Carroll, R.L.S., Tennessee License Number 1335, October 1996.
Being the same property conveyed to Douglas Murawski and Anastacia Marco, as joint tenants with right of survivorship, by deed from Micheal P. Dempsey, unmarried, incorrectly referred to as Michael E. Dempsey, dated July 20, 2007, and of record in Book 267, Page 523, in the Register's Office of Lawrence County, Tennessee. Also being the same property conveyed to Douglas Murawski by deed from Anastacia Marco, dated August 4, 2011, and of record in Book 439, Page 846, in the Register's Office of Lawrence County, Tennessee.
This is an attempt to collect a debt, and any information obtained will be used for that purpose.
Said sale will be subject to all unpaid taxes, and governmental zoning and subdivision ordinances in effect on the day of sale, and to any restrictions, easements and other encumbrances of record, and other superior matters of record which may affect said property; as well as any prior liens or encumbrances as well as priority created by a fixture filing; and/or any matter that an accurate survey of the premises might disclose.
Said Deed of Trust recites title as unencumbered, except as noted herein, but sale will be made as Substitute Trustee only, without covenants of seizin or warranties of title.
The sale will be conducted subject to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and to final confirmation and audit of the status of the loan with the holder of the Deed of Trust.
The right is reserved to adjourn the day of the sale to another day, time and place certain without further publication, upon announcement at the time and place for the sale set forth above.
The failure of any high bidder to pay the purchase price and close the sale shall, at the option of the Substitute Trustee, be cause for rejection of the bid, and if the bid is rejected, the Substitute Trustee shall have the option of making the sale to the next highest bidder who is ready willing, and able to comply with the terms thereof. The proceeds derived from the sale of the property will be applied as provided in said Deed of Trust. Announcement made on the day of the sale will supersede the terms and provisions of any printed announcement of sale.
